China cosmetics quality and safety managers must be appointed to meet the requirements set by the Cosmetics Supervision and Administration Regulation (CSAR) for filing or registration of cosmetics.
On April 27, 2022, the NMPA (National Medical Products Administration) made a public announcement (No.224-2022) in response to the Jilin MPA and Chongqing MPA regarding the qualification requirements of the person in charge of cosmetics quality and safety in China.
Cosmetics registrants, Domestic Responsible Agents (DRA) and entrusted production enterprises must be equipped with a person in charge of quality and safety.
According to Article 32 of the CSAR, the person in charge of cosmetics quality and safety should possess:
- professional knowledge in cosmetics safety and quality management; and
- over 5 years of experience in cosmetics production or in the field of safety and quality management.
In the recent announcement, the NMPA further clarified that experience in the production of drugs, medical devices and special food products would be considered as equivalent to cosmetics only if the person applying for the role possesses and can demonstrate professional knowledge in cosmetics safety and quality management.
Note: Special food products include health food, formula for special medical purposes and infant formula, etc.
China Cosmetics Quality and Safety – NMPA Internal Guidelines
The provincial Medical Products Administration (MPA) departments are in charge of market supervision and the management of cosmetics. They are also responsible for checking if the registrants, filers, or quality and safety managers possess professional knowledge in cosmetics safety and quality management. The MPA departments must also verify whether the duties are performed to ensure product quality and safety meet the market standards.
