China electric bicycle certification implementation technical resolution has been issued by the China Quality Certification Centre (CQC) on December 19, 2023. This resolution, established through a rigorous correspondence review conducted on December 6-7, 2023, introduces several pivotal changes that directly impact certification procedures and compliance requirements. Here’s a breakdown of the key points:
1. Transition for Existing Certifications:
Any ongoing certification processes or renewals accepted before September 23, 2023, will continue to adhere to the implementation rules outlined in the 2021 edition until further notice.
2. Detailed Rules for 2023 Edition:
Designated certification bodies are mandated to draft and release Detailed Rules for the Implementation of Compulsory Product Certification for Electric Bicycles, tailored to align with the specifications of the 2023 edition. These detailed rules will serve as the definitive framework for certification processes moving forward, ensuring consistency and clarity in compliance procedures.
For changes that do not require testing, certification changes can be implemented and compulsory product certification certificates can be issued or renewed according to the version of the implementation rules listed in the compulsory product certification certificates.
3. New Certification Requirements:
The 2023 edition introduces new certification requirements, primarily revolving around standards compliance and production consistency. Specifically, certifications will now be based on standards such as GB 42296-2022 and GB 42295-2022. Additionally, stringent production consistency criteria have been implemented, emphasizing the need for alignment with updated regulations.
- GB 42296-2022 has been implemented from July 1, 2023, onwards. Certification processes shall be carried out in accordance with GB 42296-2022 from September 23, 2023, onwards;
- GB 42295-2022 certification processes must be carried out from January 1, 2024, onwards, or voluntarily in advance.
4. Updates in Standards:
It’s imperative to note the revisions in relevant standards, including the replacement of GB14023-2011 with GB14023-2022whereas Article 6.6 of GB17761-2018 shall be referring to the latest GB14023 requirements as implemented since November 1, 2023.
5. Follow-up Inspection Protocol:
Post-certification follow-up inspections will undergo a transitional phase, with inspections conducted according to the rules listed on the compulsory product certification certificate. As the transition progresses, inspections will gradually shift from 2021 to 2023 edition rules, ensuring compliance with the latest regulatory frameworks.
6. Product Certificate Filing:
Compliance with version-specific implementation rules is paramount in product certificate filing. As regulations evolve from the 2021 to the 2023 edition, certification documentation must be updated accordingly to reflect the latest requirements.
7. Transition Period for Certificate Conversion:
Valid certificates issued under the 2021 rules must undergo conversion to the 2023 edition before November 1, 2024. Failure to complete this conversion within the designated timeframe may result in suspension or revocation of the certificate.
