Innovative provisions for cosmetics in Pudong, Shanghai came into force on August 1, 2022. The Shanghai People’s Congress Standing Committee issued “Several Provisions on the Innovative Development of the Cosmetics Industry in Pudong New Area of Shanghai” on July 22, 2022, to enable customizable product packaging, encourage new business model adaptation, as well as to optimize the route-to-market for cosmetics within the Pudong New Area.
Personalization of cosmetics packaging can now be offered to end-customers in Pudong, Shanghai
Applicants, domestic responsible agents (DRAs), or entrusted original equipment manufacturers (OEMs) of general cosmetics (excluding children’s cosmetics, eye care cosmetics, cosmetics using new ingredients, etc.) can now provide packaging and sub-assembly services according to the consumers’ specifications, however, the business location of the service(s) provided must be set within the Pudong New Area.
If there is direct contact with the product content during the provision of on-site packaging or sub-assembly services, a production license is required to be obtained by the Pudong New Area Administration for Market Regulation (AMR). A risk assessment of the product’s quality and safety shall be carried out and submitted for the application of the production license with the Pudong New Area AMR. Applicants or DRAs should have a well-established quality management system for the production of cosmetics, and regularly submit self-inspection reports of the production quality management system to the Pudong New Area AMR. Integrated service platform for cosmetic ingredients
Shanghai encourages industrial parks and third-party institutions to establish cosmetic raw material integrated service platforms to provide raw material supply and quality management services for cosmetic registrants, filers, and entrusted manufacturers in the Pudong New Area.
The integrated service platforms should:
- Establish a system for keeping the inspection records of incoming raw materials
- Strengthen the management of inspection, testing, storage and transportation of raw materials
- Maintain good record-keeping of procurement and supply of raw materials
Conditions for foreign registrants, filers or DRAs to affix Chinese labels on cosmetics packaging
Foreign registrants, filers or DRAs must ensure labelling and traceability are complete for the primary packaging units of imported cosmetics before carrying out the following services, by themselves or entrusting other business enterprises, in certain permitted areas of the Pudong New Area:
- Attach the label of the Chinese name and expiration date on the primary packaging unit.
- Provide packaging and labelling services according to the National Medical Products Administration (NMPA) labelling requirements without exposing, or having direct contact with, the cosmetic contents.
Optimization of route-to-market
Exemption of special cosmetics registration certificate or general cosmetics filing can be granted for:
- Cosmetic samples imported to the Pudong New Area for registration and filing inspection
- Cosmetics for product display in exhibitions that are:
- Intended for corporate R&D
- Not free product testing samples
- Not for sale
After participating in the China International Import Expo or other cosmetic exhibition events within the Pudong New Area, exhibitors with the approval from respective customs and government departments can convert imported cosmetics to bonded goods for sales via promotional events or the cross-border e-commerce platform.
